Civil Asset Forfeiture defies the 5th amendment.
The Fifth Amendment to the U.S. Constitution, ratified in 1791, protects against self-incrimination, double jeopardy, and requires due process and just compensation for property taken by the government. It also guarantees grand jury indictment for federal felonies and limits eminent domain to public use with fair payment.
Therefore Civil Asset Forfeiture is unconstitutional. Seized property requires due process and compensation.
