The Organ Donation (Deemed Consent) Act 2019, implemented in England on May 20, 2020, represents a deeply troubling shift in how society views bodily autonomy. Under this “opt-out” system, all adults are presumed to consent to organ donation upon their death unless they take proactive steps to reject it. This law, far from offering the freedom of choice, imposes an assumption of consent that should never be a default decision regarding something so profoundly personal.

The law disregards individual agency by assuming all adults agree to donate their organs. For those who do not wish to participate, they must go through the effort of actively opting out—either online, by phone, or other means. What about those who may not be aware of the law or have the capacity to make such decisions in the first place?

While certain groups are excluded, including minors and those lacking mental capacity, the system places far too much responsibility on families, demanding they confirm the wishes of the deceased. This law, disguised as an advancement, ultimately undermines personal choice and turns a deeply intimate decision into a legal formality. What happened to the fundamental right of choice over our own bodies?
