President Trump takes action to launch a new census excluding illegals, aiming for accuracy based on 2024 election data

Trump ordered a new census. Said it will leave out illegals. “People who are in our country illegally will NOT BE COUNTED IN THE CENSUS.” https://www.politico.com/news/2025/08/07/trump-new-census-00497025

Commerce started prep. No law passed, but no law blocks it either. “President Donald Trump said Thursday he has directed the Department of Commerce to begin work on a new census that excludes undocumented immigrants.” https://www.msn.com/en-us/news/politics/trump-orders-new-census-excluding-undocumented-immigrants/ar-AA1K5k9G

The Constitution says count every ten years. But it doesn’t ban extra counts. “Under that same law, the commerce secretary can conduct a mid-decade census, in 2025, but the results can’t be used for redistributing each state’s share of seats in the U.S. House of Representatives and votes in the Electoral College.” https://www.kpbs.org/news/politics/2025/08/07/trump-wants-a-new-u-s-census-to-exclude-people-here-illegally-itd-be-unprecedented

Supreme Court blocked the citizenship question in 2019. But said the reason was weak, not illegal. “The Supreme Court rejected the citizenship question in a 5-4 decision, but concluded the reason given by the administration was ‘contrived’ and ‘pretextual.’” https://www.cbsnews.com/news/trump-census-2030-undocumented-immigrants/

The Constitution says Congress runs the census. But Commerce can run surveys. Mid-decade counts are allowed. They just can’t change House seats unless Congress says so.

Trump didn’t break the law. He used a legal gap. The Supreme Court didn’t say no. It said try again with a better reason.

Election data is a reason. Funding gaps are a reason. District shifts are a reason. If Congress backs it, the numbers count. If courts allow it, the map changes.
