Missouri attorney general scores major victory, court blocks Biden’s parole-in-place program.

In a significant legal win, Missouri Attorney General Andrew Bailey, supported by attorneys general from 16 other states, succeeded in having the court block the Biden-Harris Administration’s “parole in place” (PIP) program. This controversial program aimed to allow over 1.3 million undocumented immigrants to apply for permanent residency without leaving the U.S., provided they were the spouse or stepchild of a U.S. citizen. The court found the program unconstitutional, effectively stopping it.

Immigration attorneys, however, are already advising those affected on potential alternatives, such as the I-601A Waiver. This waiver allows specific undocumented immigrants to apply for an exemption from the unlawful presence penalty. If approved, they could attend visa interviews without facing mandatory re-entry bars.

This ruling underscores the ongoing legal battle over immigration policies and the efforts to uphold constitutional limits on executive power. The blocked PIP program reflects the Biden Administration’s approach to immigration reform, but with this decision, the future of such policies faces increased scrutiny.
