Jack Smith’s vendetta to take down former President Donald Trump could backfire, according to Harvard Law School professor emeritus Alan Dershowitz. Smith recently indicted Trump on four criminal charges related to his alleged involvement in the events of January 6, 2021.
Dershowitz noted how Smith omitted a key portion of then-President Donald Trump’s speech in Washington, D.C. on January 6th. At Trump’s “Stop the Steal” rally, Smith emphasized how Trump told supporters to “fight like hell,” but failed to mention Trump ordered everyone to “peacefully and patriotically make your voices heard.”
Trump said, “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”
“Under the indictment itself, Jack Smith could be himself indicted,” Dershowitz said bluntly. “He told a direct lie in this indictment. He purported to describe the speech that President Trump made on January 6th.”
“And he left out the key words, when President Trump said, ‘I want you to demonstrate peacefully and patriotically. You know, a lie by omission, under the law, can be as serious as a lie by commission,” he added.
In Smith’s indictment, many Americans believe there is a factual error. Smith argues that Trump knowingly pushed false election claims about the 2020 election without evidence. Smith cites the Cybersecurity and Infrastructure Security Agency (CISA), which has stated there was no evidence of compromised voting systems in the 2020 election.
Smith’s indictment is self-defeating and contradicts the Justice Department’s own findings. At least two Iranian hackers successfully hacking into a state election computer during the 2020 election and stole voter data and conducted cyber intimidation campaign against Republican members of Congress.
