In Pennsylvania’s closely watched U.S. Senate contest, a mandatory statewide recount is set to commence, marking a high-stakes faceoff between Democratic incumbent Sen. Bob Casey and Republican challenger David McCormick.

The Associated Press called the race for McCormick last week, projecting Casey could not make up the deficit based on uncounted ballots.

However, with the count continuing, preliminary tallies revealed McCormick’s narrow 28,000-vote lead falls within Pennsylvania’s 0.5 percent margin for a legally mandated recount, Secretary of State Al Schmidt announced Wednesday.

Casey declined the option to waive the recount by the noon deadline, cementing the next procedural steps for county election officials.

McCormick sues Bucks County for counting undated mail ballots

A lawsuit has been filed in a still-ongoing race for U.S. senator in Pennsylvania.

David McCormick, the Republican candidate who may have unseated Democratic incumbent U.S. Sen. Bob Casey, has filed a lawsuit against the Bucks County Board of Elections.

The suit, which was also filed by the Republican National Committee and Republican Party of Pennsylvania, is over Bucks’ decision to count 405 undated or misdated mail ballots from the Nov. 5 election.

The suit says the decision to count the ballots is “legally erroneous” because the Pennsylvania Supreme Court has ruled that undated or misdated mail ballots are invalid and cannot be counted for the 2024 election.

It notes that other counties have decided to not count misdated mail ballots.

The Bucks County elections board voted 2-1 during a meeting Tuesday to count the 405 misdated ballots, the suit says.

The race between McCormick and Casey is so close that it has triggered a mandatory recount under Pennsylvania law, the department of state announced Wednesday.

The unofficial results, as of Wednesday, show McCormick leading Casey by 0.43%. Less than half a percentage point triggers the automatic recount.

The vote counts are McCormick with 3,380,310 and Casey with 3,350,972, a difference of just under 30,000 votes.

Pennsylvania Democratic leadership held a press conference Tuesday to celebrate the victory of keeping their very slim 102-101 majority in the state house and announce their plans for the next term.

“Here in Harrisburg, in the ‘People’s House’, we held onto the people’s majority, because we’ve been delivering for the work of the people,” said House Speaker Joanna McClinton (D-Philadelphia). “In 2021, when my colleagues, many are surrounding me, gave me the opportunity to be the first woman and person of color to sit on the legislative redistricting commission, it was my job to make sure that Pennsylvania’s House looked like Pennsylvania.”
